General terms & conditions

These General Visitor Terms and Conditions belong to the general partnership PARADIGM (hereinafter: ‘PARADIGM’), Chamber of Commerce (KvK) number 42051910, and apply to agreements concluded with visitors of events organised by it or on its behalf.

Article 1 Definitions

PARADIGM: the general partnership PARADIGM as well as, where applicable, the relevant affiliated undertakings, established and doing business in (9743 AN) Groningen at Energieweg 10, whose business consists, among other things, of (causing the) provision of services in the field of performing arts and with regard to the (causing the) organisation of events and the associated activities and services;

Visitor: any natural person who is not acting in the exercise of a profession or business and who directly or indirectly concludes an agreement with PARADIGM in connection with attending an Event, as well as anyone who is present in or around the Event Location;

Event: a one- or multi-day occurrence, including a (music) performance and/or other manifestation, a concert, dance event, business event, festival and any associated camping facilities and/or a public or private occurrence, indoors and/or outdoors, in which one or more persons participate, organised and/or facilitated by or on behalf of PARADIGM at the Event Location;

Event Location: location(s) where an Event takes place, which is used for the Event to be organised and/or facilitated by or on behalf of PARADIGM, including any Camping Site;

General Visitor Terms and Conditions: the present General Visitor Terms and Conditions that apply to the (legal) relationship between the Visitor and PARADIGM;

Camping Site: the specific camping facility or campsite designated, where applicable, by or on behalf of PARADIGM, whether or not located at or in the vicinity of the Event Location;

Camping Regulations: any regulations/house rules of the owner of the Camping Site that apply to the Visitor’s stay at the Camping Site;

Agreement: any contractual legal relationship between the Visitor and PARADIGM that has been concluded in accordance with these General Visitor Terms and Conditions and/or arises from them in connection with attending an Event, as well as any other provision or expression validly declared applicable to the (legal) relationship between the Visitor and PARADIGM in accordance with these General Visitor Terms and Conditions;

Privacy Statement: the privacy statement setting out PARADIGM’s privacy policy, available on the Website(s) and applicable to every form of processing of personal data by or on behalf of PARADIGM;

Social Media: the social media channels specifically affiliated with the Website(s) and other (promotional) expressions of or on behalf of PARADIGM that are registered in the name of or for the benefit of PARADIGM;

(Pre-)sale Address: a (pre-)sale organisation engaged by PARADIGM for the sale of tickets for Events, including those where Tickets can be purchased online/digitally;

Ticket: a validly obtained proof, issued by or on behalf of PARADIGM, demonstrating the Visitor’s authorisation to be present at the Event Location;

Ticket Price: the price for a Ticket, excluding any additional service and/or administration costs;

Website(s): the website(s) of PARADIGM and any specific affiliated website(s) and Social Media accounts of Events registered in the name of or for the benefit of PARADIGM, including any special associated apps operated by or on behalf of PARADIGM.

Article 2 Applicability

  • These General Visitor Terms and Conditions apply to every Agreement concluded between PARADIGM and the Visitor, regardless of the manner in which this Agreement is concluded, as well as to every visit by the Visitor to the Event Location.
  • PARADIGM has the right to amend these General Visitor Terms and Conditions in whole or in part at any time. PARADIGM will inform the Visitor of the amendments to the General Visitor Terms and Conditions in good time by announcing this on its Website. If the Visitor is of the opinion that the amendments are contrary to reasonableness and fairness, the Visitor must notify PARADIGM of this within 10 (ten) working days after the notification, failing which the Visitor is deemed to agree to the amendments.
  • PARADIGM expressly rejects the applicability of any general terms and conditions of the Visitor.
  • The nullity of any provision of these General Visitor Terms and Conditions does not affect the validity of the remaining provisions of these General Visitor Terms and Conditions.
  • In addition to the General Visitor Terms and Conditions, any (general) terms and conditions of the ticket provider may (also) apply to the purchase of a Ticket.
  • Where applicable, in addition to the General Visitor Terms and Conditions and the House Rules, any (general) terms and conditions and/or house rules of the campsite concerned may apply to a stay at a Camping Site designated by or on behalf of PARADIGM.
  • We reserve the right to amend these General Terms and Conditions at any time.

Article 3 Offers and conclusion of the Agreement

  • Information, offers, communications and price quotations relating to Events and/or (the sale of) Tickets are provided or supplied by PARADIGM and/or third parties as accurately as possible, orally, by telephone, by e-mail, via the Website(s) and/or Social Media. PARADIGM accepts no liability for any inaccuracies or incompleteness in the aforementioned communications made by PARADIGM and/or third parties.
  • An Agreement is concluded at the moment the Visitor purchases a Ticket from PARADIGM or a (Pre-)sale Address engaged by PARADIGM, or at least has accepted an offer from or on behalf of PARADIGM to obtain one, whether or not against payment, and/or upon entering the Event Location.

Article 4 Access and Ticket

  • Upon entering the Event Location and during the period that the Visitor is present at the Event Location, the Visitor must possess a valid identity document, a validly (obtained) Ticket and, if a discount is claimed, the document entitling them to the discount, and must show these on first request by employees of PARADIGM, employees of the Event Location, security personnel, police and/or other competent authority. If it appears that the Visitor is under 18 years of age, access to the Event is denied without further ado, unless explicitly determined otherwise by PARADIGM, without PARADIGM being obliged to refund the Ticket Price or any service and/or administration costs charged and/or other costs incurred.
  • A Ticket is issued to the Visitor once and grants one Visitor single access to the Event and the Event Location and automatically loses its validity after leaving the Event Location.
  • If an Event is rescheduled by PARADIGM to another date, for example as a result of or in connection with force majeure, the Ticket remains valid for the new date on which the Event will take place. Should the Visitor be unable or unwilling to attend the Event on the new date, the Visitor is entitled to return the Ticket to PARADIGM or to a (Pre-)sale Address engaged by PARADIGM against a refund of the fee stated on the Ticket, regardless of the price the Visitor paid for the Ticket. Service and/or administration costs will not be refunded.
  • A Ticket only grants the holder of the Ticket access to the Event Location. It is the Visitor’s own responsibility to ensure that they become and remain the holder of the Ticket. Tickets are and remain the property of PARADIGM.
  • A Ticket may consist of a document issued by or on behalf of PARADIGM or a barcode provided by or on behalf of PARADIGM. The barcode is a unique code that is provided to the Visitor via electronic communication (for example e-mail). If the Visitor has chosen to receive the Ticket in this way, the Visitor must ensure that this Ticket can actually and securely be provided via electronic communication. PARADIGM guarantees neither the confidentiality nor the receipt of the Ticket.
  • Only purchase via PARADIGM or (Pre-)sale Addresses engaged by it guarantees the validity of the Ticket. Tickets may be declared invalid by or on behalf of PARADIGM and/or the Visitor may be denied access to the Event Location by or on behalf of PARADIGM if it appears that the Ticket was not obtained from PARADIGM or from a (Pre-)sale Address engaged by PARADIGM, or in the event of fraud, misuse and/or other violation of (any of) the rules laid down in articles 4.1 to 4.11.
  • When the Visitor claims a discount upon purchasing a Ticket, the Visitor must show the document entitling them to the discount.
  • From the moment the Ticket is made available to the customer, the risk of loss, theft, damage or misuse of the Ticket rests with the customer. The Visitor is not entitled to a refund of the Ticket Price or any other compensation in the event of loss, theft, damage or misuse of the Ticket, nor in the event that the Visitor, for whatever reason, does not use the Ticket. A Ticket once obtained cannot be returned or exchanged.
  • The Visitor is not permitted to (have) remove(d) and/or alter(ed) statements relating to copyrights, trademarks, logos, designs, trade names and/or other industrial or intellectual property rights of PARADIGM and/or its licensors from the Tickets, or to otherwise infringe the intellectual property rights of PARADIGM.
  • PARADIGM reserves the right to set a maximum on the number of Tickets that may be obtained per (potential) Visitor; in that case the (potential) Visitor is obliged to comply with this.
  • Access to PARADIGM events that take place outdoors is, in principle, open to Visitors with a valid ticket until 8.00 p.m. After 8.00 p.m. Visitors are no longer admitted to the event location, unless PARADIGM decides otherwise in a specific case.

Article 5 Prohibition on resale of Tickets

  • It is prohibited to (have) resell, offer for sale or provide a Ticket to third parties in any way for commercial purposes, except via an additional official sales channel for secondary ticketing designated by PARADIGM such as Ticketswap. It is likewise prohibited to (have) exceed(ed) any maximum set by PARADIGM as referred to in article 4.10 of these General Visitor Terms and Conditions, directly or indirectly, including by (having) Tickets purchased via third parties and subsequently (having) these Tickets obtained via third parties resold, offered for sale or provided to third parties in any way for commercial purposes. Regular personal resale of a Ticket via TicketSwap is excepted from the foregoing.
  • The Visitor is not permitted to (have) make any advertising or any other form of publicity in connection with the Event and/or any part thereof.
  • If the Visitor makes their Ticket available to third parties free of charge and not for commercial purposes, the Visitor is in that case obliged to impose all obligations of the Visitor arising from an Agreement or these General Visitor Terms and Conditions on those third parties without exception. The Visitor warrants that the aforementioned third parties comply and/or will comply with all the aforementioned obligations.
  • If the Visitor does not comply with the obligations under this article, PARADIGM is entitled to designate those Tickets as invalid, the Visitor may be denied access to the Event and the Visitor owes PARADIGM an immediately payable penalty of € 100,= (in words: one hundred euros) per Ticket and € 100,= (in words: one hundred euros) per day that this violation continues, without prejudice to the right of PARADIGM to also claim performance and/or full compensation. The holder of an invalid Ticket is not granted access to the Event or the Event Location and has no right to any compensation.

Article 6 Liability

  • Travelling to and from, as well as entering, staying at and carrying out activities at, and leaving the Event Location and attending the Event at the Event Location, is entirely at the Visitor’s own risk.
  • PARADIGM excludes its liability for any damage as a result of the cancellation, alteration or relocation of an Event, nor for any other damage, on whatever grounds, that is directly or indirectly the result of acts or omissions of PARADIGM and/or its subordinates, non-subordinates, auxiliary persons, third parties and/or other persons engaged by it in the context of the Event, during or in connection with the Event, including travelling to and from or staying at the Event Location, unless the damage is the result of intent or gross negligence on the part of PARADIGM.
  • PARADIGM excludes its liability for the manner in which the programme of the Event is given substance, whether or not in amended form, including the content and duration of the programme of the Event.
  • If and insofar as PARADIGM should be liable to the Visitor on any ground whatsoever for any damage suffered by the Visitor, this liability is at all times limited to direct damage up to the amount that will be paid out under PARADIGM’s statutory liability insurance, and only if it is legally obliged to do so. In such a case, PARADIGM is also only liable if the Visitor notifies PARADIGM of the shortcoming in writing without delay and in a proper manner, whereby a reasonable period is also set to still fulfil the obligation or remedy the error, and if PARADIGM continues to fall short in fulfilling that obligation or remedying the error even after that notice of default.
  • PARADIGM excludes its liability for loss of clothing, items and/or other property of the Visitor and accepts no liability as such. If the Visitor can demonstrate with concrete evidence that the loss of clothing, items and/or other property of the Visitor is solely the result of intent or gross negligence on the part of (personnel of) PARADIGM, the Visitor must report this to PARADIGM without delay and in writing, on penalty of forfeiting any claim to compensation, and PARADIGM will, upon presentation of a valid proof of purchase of the property concerned, pay that Visitor compensation up to a maximum of the purchase amount, with a maximum of € 250 (in words: two hundred and fifty euros).
  • Found objects must be handed in to the person working behind the bar, the counter at the lockers or the cash desk of the Event Location. Found objects are kept by PARADIGM or the lessor of the lockers for two weeks, during which period the rightful owner can collect the property lost by them from PARADIGM or the lessor of the lockers.
  • PARADIGM excludes its liability for hearing damage, visual damage, blindness and/or other physical injury of the Visitor in connection with the Event. The Visitor is expressly aware that loud and/or amplified music may be played during the Event and at or around the Event Location. PARADIGM advises the Visitor to protect their hearing during the Event with special earplugs and to give their hearing a rest from time to time by going to a room or place where no music is played.

Article 7 Cancellation or relocation of the Event

  • PARADIGM is entitled to alter (parts of) an Event. Only in the event of cancellation of the Event in its entirety will PARADIGM, at the written request of the Visitor, refund the Ticket Price thereof to the original purchaser of the Ticket, but not the administration and service costs.
  • PARADIGM is entitled to cancel or relocate (parts of) an Event. It is the Visitor’s responsibility to check whether an Event is being/has been cancelled or is being/has been relocated and what any new time or new location will be. In the event of cancellation or relocation, PARADIGM will do its best to ensure that, as soon as it is aware of this, the Visitor is informed thereof. However, PARADIGM cannot guarantee that the Visitor will receive this information before the start of the Event. PARADIGM is not liable for any damage in this respect, and is not obliged to compensate or refund the Ticket Price of the Ticket and any service, payment and/or administration costs charged and/or other costs incurred.
  • Tickets for Events that are relocated remain, in principle, valid for that relocated Event. For more information, you can contact PARADIGM via info@paradigm050.com and/or via the Website(s).
  • If an Event is rescheduled by or on behalf of PARADIGM to another date, for example as a result of or in connection with force majeure, the Ticket remains valid for the new date on which the Event will take place. Should the Visitor be unable or unwilling to attend the Event on the new date, the Visitor is entitled to return the Ticket to PARADIGM or to a (Pre-)sale Address engaged by PARADIGM against a refund of the fee stated on the Ticket, regardless of the price the Visitor paid for the Ticket. Service and/or administration costs will not be refunded.

Article 8 House Rules for the Event

  • PARADIGM’s House Rules apply to every visit by the Visitor to PARADIGM Events. Visitors are required to behave in accordance with these House Rules of PARADIGM and/or the Event Location, as well as the rules of good decency and good morals prevailing in society. If, in the opinion of employees of PARADIGM and/or the Event Location and/or security personnel, the Visitor does not behave in such a manner, the Visitor may be addressed about this by employees of PARADIGM and/or the Event Location and/or security personnel. In the event of a violation of the House Rules or any repetition or continuation of conduct of the Visitor that is not in accordance with the said House Rules and the rules of good decency and good morals prevailing in society, the Visitor may be denied access to the Event and, if necessary, be handed over to the police, without the right to a refund of the Ticket Price and any service and/or administration costs charged and/or other costs incurred.
  • The Visitor is not permitted to record the visit to the Event in any form whatsoever, on any (digital) medium whatsoever, including photographing, filming, or any other manner of making sound and/or image recordings of the Event. If the Visitor has recorded the Event in a non-professional sense, such as with a smartphone, the Visitor is only permitted to use these recordings for their own private use and they may not in any way be used or made public by the Visitor for commercial purposes.
  • PARADIGM reserves the right to make sound and/or image recordings during an Event. The Visitor who attends an Event:
  • consents to the recording and/or (re)use of their name, voice, portrait and/or image by means of audio and video display, broadcast or other form of distribution, whether or not broadcast live and recorded, including photos or other current and/or future media technologies; and
  • grants unconditional permission for the (re)use as referred to in sub a), for an indefinite period, worldwide and free of charge; and
  • holds neither PARADIGM nor parties that use image and/or sound material with PARADIGM’s permission for commercial or non-commercial purposes liable for the (re)use of this image and/or sound material; and
  • waives their portrait rights, image rights and persona rights insofar as it concerns images in and around the Event Location in which they are recognisably depicted; and
  • acknowledges that a video surveillance system is operational and agrees that video recordings of the Visitor may be made by or on behalf of PARADIGM in the context of public order and safety; and
  • acknowledges that any intellectual property rights, including copyrights and neighbouring rights, with regard to the image and/or sound material made by or on behalf of the Visitor, fall in undivided ownership to PARADIGM; the Visitor will, on first request of PARADIGM, free of charge, provide full cooperation with all any formalities required to bring about a transfer of rights or other granting of rights; PARADIGM is at all times entitled to (have) use(d) the image and/or sound material referred to here made by or on behalf of the Visitor, in any way whatsoever.
  • The Visitor is not permitted, without the express written permission of PARADIGM, to distribute or have distributed promotional material at the Event Location, including samples, flyers, advertising and/or leaflet material, insofar as the law permits this.
  • At the Event Location it is only permitted to smoke in the designated (smoking) area(s). Outside these (smoking) area(s) it is expressly not permitted to smoke. PARADIGM will make reasonable efforts to point out to the Visitor the smoke-free nature of (parts of) the Event Location. However, PARADIGM does not guarantee that the Event is entirely smoke-free. The fact that the Event (may) not be entirely smoke-free does not entitle the Visitor to a refund of the Ticket Price or any other compensation. In the event of a violation by the Visitor of the smoking ban, the Visitor will, if possible, be removed immediately from the Event and the Event Location. Any fines imposed on PARADIGM as a result of this violation of the smoking ban will be recovered from the Visitor. Smoking in this context also includes electronic smoking.
  • PARADIGM will undertake everything that reasonably lies within its possibilities to safeguard the safety of the Visitor at the Event Location as much as possible. In the context of safety at the Event Location, the Visitor is therefore obliged, on first request of employees of PARADIGM and/or the Event Location, security personnel, police and/or other competent authority:
  • to cooperate with the examination of clothing (searching), both upon access to the Event and the Event Location and during the stay at the Event and the Event Location; and/or
  • to allow inspection of any (hand/back/carrying) bag(s) carried, both upon access to the Event and the Event Location and during the stay at the Event and the Event Location; and/or
  • to pass through a detection gate; and/or
  • to identify themselves, both upon access to the Event and the Event Location and during the stay at the Event and the Event Location.

The Visitor who does not wish to submit to this may be refused or denied access to the Event and the Event Location without the right to a refund of the Ticket Price or any other compensation.

  • The Visitor is not permitted to (unnecessarily) loiter in front of emergency exits and places at the Event Location where fire extinguishers hang or other fire-prevention and/or safety measures have been taken.
  • The Visitor is expressly not permitted to bring, or at least possess at the Event Location, professional photo, film, drone and/or sound and/or other recording equipment, glassware, plastic bottles, cans, fireworks, drugs, nitrous oxide cartridges, (fire)arms and/or other dangerous objects and/or substances, food and/or (alcoholic) beverages and/or (pet) animals, on penalty of confiscation of these items and/or transfer to the police.
  • The Visitor is not permitted to affect and/or damage (the inventory of) the Event Location in any way whatsoever. Nor is the Visitor permitted to cause danger to other visitors, personnel and/or employees of PARADIGM and/or (personnel and/or employees of) contractors and emergency services, including by climbing on objects and/or being on/in objects present at or around the Event Location (such as, for example, stages, fences, containers, etc.). If the Visitor causes damage in any way to (the inventory of) the Event Location, the Visitor is obliged to compensate this damage.
  • The Visitor is obliged to follow instructions, regulations and/or directions of employees of PARADIGM and/or the Event Location, security personnel, the police and/or other competent authority on first request. These instructions may also relate to preventing (undesirable) group formation, aggressive behaviour, indecent or offensive behaviour, calamities, endangerment, discrimination, insult, threat, the wearing of provocative clothing, insignia, badges, headgear and flags, etc.
  • If the Visitor refuses to comply with the (safety) regulations referred to in this article 8, the Visitor may be denied access to the Event and/or the Event Location and be removed from the Event Location, without the right to any refund of the Ticket Price of the Ticket and any service and/or administration costs charged and/or other costs incurred.
  • Employees of PARADIGM and/or the Event Location, security personnel, the police and/or other competent authority may, in the event of a violation as referred to in this article 8, request the Visitor at any time to come along, be requested to hand over a copy of their valid identity document, and may subsequently be removed from the Event Location. In that case, the Visitor will at all times voluntarily, without resistance, cooperate with such a request. PARADIGM will subsequently decide, during or after the Event, whether or not in consultation with the authorities concerned, whether the Visitor will be imposed a ban for one or more Events of PARADIGM.
  • Consumption vouchers or tokens purchased during the Event or during the stay at the Event Location are only valid during the Event concerned and cannot be exchanged by the Visitor. PARADIGM will never proceed to refund the purchase amount of these vouchers or tokens during or after the Event. It is not possible to (have) resell consumption vouchers or tokens already purchased. Visitors are prohibited from (having) reselling consumption vouchers or tokens purchased.

Article 9 Force majeure

PARADIGM cannot be held liable for damage of the Visitor that has arisen as a result of force majeure and accepts no liability as such. Force majeure also includes: strikes, fire, extreme weather conditions, epidemics, (threat of) terror and all other circumstances beyond PARADIGM’s control. In the event of force majeure, PARADIGM has the right to reschedule the Event to another date or to cancel the Event. In the event of cancellation, PARADIGM is not obliged to provide a refund for tickets and/or other ‘presale’ monies.

Article 10 Privacy and personal data

  • By concluding an Agreement with PARADIGM, (personal) data of the Visitor may be collected, recorded and stored in a data file. This (personal) data provided by the Visitor is processed by PARADIGM.
  • PARADIGM’s privacy policy, which can be consulted on the Website, applies to the processing of the (personal) data provided by the Visitor. PARADIGM handles the obtained (personal) data carefully and processes it solely in accordance with the Dutch Personal Data Protection Act, and as of 25 May 2018 in accordance with the General Data Protection Regulation (GDPR) and related implementing legislation.   • Upon concluding the Agreement with PARADIGM, the Visitor expressly grants permission for the processing of (personal) data in accordance with PARADIGM’s privacy policy.
  • If (image) recordings are made with security cameras during an Event, PARADIGM may, in the event of calamities, surrender these to third parties, including the police and judicial authorities.

Article 11 Complaints

PARADIGM will undertake everything that reasonably lies within its possibilities to make the Visitor’s stay during the Event at the Event Location as pleasant as possible. In doing so, PARADIGM endeavours to minimise any nuisance or inconvenience for the Visitor and to safeguard the safety of the Visitor as much as possible. Should the Visitor unexpectedly have complaints regarding the performance of the Agreement and/or the services of PARADIGM, the Visitor can report this in writing by sending an e-mail to info@paradigm050.com. Complaints must be reported to PARADIGM no later than within 7 (seven) days after the date of the stay at the Event Location.

Article 12 Disputes

  • These General Visitor Terms and Conditions and all Agreements to which these General Visitor Terms and Conditions apply are governed exclusively by Dutch law.
  • All disputes, of whatever nature, that arise between a Visitor and PARADIGM in connection with or as a result of the Agreement or further agreements implementing it, will be submitted exclusively to the competent court in Midden-Nederland. Disputes between PARADIGM and Visitors, including complaints as referred to in article 11 of these General Visitor Terms and Conditions, may alternatively be submitted to the Disputes Committee Foundation for Consumer Affairs (Stichting Geschillencommissie Consumentenzaken, SGC), as part of the so-called Online Dispute Resolution (ODR) platform (https://www.eccnederland.nl/nl/online-dispute-resolution-odr).
  • If the General Visitor Terms and Conditions are also used in a language other than Dutch, the Dutch text is decisive in the event of disputes about its interpretation.
